Wish平台知识产权政策介绍

Wish针对仿品和侵占知识产权的行动制订了严厉的政策。

如果Wish单方面认定您在出售仿品，您赞成，在不限制Wish在本协定中的权力或法律权力的情形下，Wish可以单方面暂停或终止您的出售权限或扣留或罚没本应支付给您的款项。

4.1严禁出售仿品

严禁出售模拟或影射他人知识产权的产品。如果商户上架仿品，这些产品将被移除，且相应账户将面临赔款，可能还会被暂停交易。

4.2严禁出售侵占其他方实体的知识产权的产品

产品的图片和文本信息不得侵占他人的知识产权。知识产权包含但不限于版权、商标和专利。如果商户上架侵占他人知识产权的产品，这些产品将被移除，且相应账户将面临赔款，可能还会被暂停交易。

4.3商户需负责提 品的出售授权证据

如果产品是仿品或侵占知识产权，应由商户负责提供出售该产品的授权证据。

4.4严禁提供不精确或具有误导性的出售授权证据

如果商户提供不精确或具有误导性的产品出售授权证据，其账户将被暂停。

4.5针对仿品或侵占知识产权的赔款

所有产品均会接收仿品和知识产权侵权审核。如果产品被发觉违背了Wish的政策，该产品将会被移除，且所有付款将被暂扣。商户可能将面临每件仿品更高$10.00*的赔款。赔款仅可在其生成后的90个自然日内进行申诉和审批。如果赔款申诉未在其生成后的90个自然日内获批，赔款将不予撤销。

4.6对核准上架产品处以仿品赔款

在商户更改产品名称、产品描写或产品图片后，经过审批的产品也要再次审核，看其是否为捏造品或是否侵占了知识产权。在产品复审期间，产品正常出售。如果商户在作者产品后产品被发觉违背Wish政策，该产品将被移除，且所有付款会被暂扣。商户的账户可能面临赔款和/或被暂停交易。

Wishhasastrictpolicyagainstcounterfeitsandintellectualpropertyinfringement.

IfWishdetermines(initssolediscretion)thatyouaresellingcounterfeitgoods,youagreethat,withoutlimitinganyofWish’srightsunderthisAgreementoratlaw,Wishmay(initssolediscretion)suspendorterminateyoursellingprivilegesorcausepaymentstoyoutobewithheldorforfeited.

4.1Sellingcounterfeitproductsisstrictlyprohibited

Sellingproductswhichmimicoralludetotheintellectualpropertyofothersisprohibited.Ifamerchantlistscounterfeitproducts,theproductswillberemovedandtheiraccountfacespenaltiesandpossiblesuspension.Learnmore

4.2Sellingproductswhichinfringeonanotherentitysintellectualpropertyisprohibited

Productimagesandtextmaynotinfringeontheintellectualpropertyofothers.Thisincludes,butisnotlimitedto:copyright,trademarks,andpatents.Ifamerchantlistsproductswhichinfringeontheintellectualpropertyofothers,theproductswillberemovedandtheiraccountfacespenaltiesandpossiblesuspension.Learnmore

4. roofofauthorizationtosellaproductistheburdenofthemerchant

Ifaproductiscounterfeitorinfringesonintellectualproperty,itistheburdenofthemerchanttoprovideprooftheyareauthorizedtoselltheproduct.

4.4Providinginaccurateormisleadingproofofauthorizationtosellisprohibited

Ifamerchantprovidesinaccurateormisleadingproofoftheirauthorizationtosellaproduct,theiraccountwillbesuspended.

4.5Penaltiesforcounterfeitorintellectualpropertyinfringement

Allproductsarereviewedforcounterfeitandintellectualpropertyinfringement.IfaproductisfoundtoviolateWishspolicy,itwillberemovedandallpaymentswillbewithheld.Themerchantmaybepenalizedupto$10.00*percounterfeitproduct.Thepenaltycanonlybedisputedandapprovedwithin90calendardaysfromwhenthepenaltywascreated.Ifthepenaltydisputeisnotapprovedwithinthe90calendardayperiodfromwhenthepenaltywascreated,thepenaltywillnotbereversed.

4.6Counterfeitpenaltiesforapprovedproducts

Approvedproductsarereviewedagainforcounterfeitandintellectualpropertyinfringementafterthemerchantchangestheproductname,productdescriptionorproductimages.Duringreview,theproductwillbeavailableforsale.IftheproductisfoundtoviolateWishspolicyaftertheedit,theproductwillberemovedandallpaymentswillbewithheld.Themerchantaccountmayreceivepossiblepenaltiesand/orsuspension.

*Thisamountmaybecalculatedinthemerchant’slocalcurrencyand/orbesubjecttoMerchantPolicy11.
